Is ESA Registration Required in Massachusetts?

Short answer: no. No Massachusetts registry exists and no Massachusetts law requires one. Here is what the state actually asks for, and how to make a request that works.

Not the Massachusetts fair housing statute, not any Massachusetts agency, and not the federal Fair Housing Act. The statute that do apply here — M.G.L. c. 151B, § 4(7A) — make no mention of registries, certificates or ID cards.

What Makes Massachusetts Different

Is There a Waiting Period in Massachusetts?

Massachusetts does not impose a required client-provider relationship period, so an evaluation and a letter can happen without a legal delay. Five states — Arkansas, California, Iowa, Louisiana and Montana — do impose one, and Massachusetts is not among them.

That is a matter of timing, not of standards. The clinician still has to conduct a real evaluation and still has to be licensed here, and a letter produced without either is no more useful in Massachusetts than a registry certificate is.
